These Terms of Service (“Terms”) govern your access to and use of the website located at spritzitup.com (the “Site”), and any products, content, or services offered by Spritz Health, operated by Spritz Health LLC (“Spritz,” “we,” “us,” or “our”). By accessing or using the Site, creating an account, placing an order, or otherwise using our products or services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Site.

1. Acceptance of Terms

By using the Site, you affirm that you have read, understood, and agree to these Terms. If you are using the Site on behalf of a business or other entity, you represent that you have authority to bind that entity.

2. Eligibility

The Site and our products are intended for adults 18 years of age or older. By using the Site or purchasing our products, you represent that you are at least 18 years old and legally able to enter into a binding contract. Our products are not intended for use by children under 18, and we do not knowingly sell to, market to, or collect personal information from anyone under 18.

3. Changes to These Terms

We may revise these Terms from time to time to reflect changes to our business, our products, or applicable law. The “Effective Date” above reflects the most recent revision. Your continued use of the Site after a revised version is posted constitutes your acceptance of the changes. We encourage you to review this page periodically.

4. About Our Products; Health & Safety Disclaimer

You acknowledge and agree that all products sold on the Site, including the Spritz Biohack product line, are sold and labeled strictly for Research Use Only (“RUO”) and are not intended for human consumption. These products are not dietary supplements, foods, drugs, or cosmetics, and are not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition in humans or animals.

No claims regarding the safety, efficacy, identity, purity, or intended use of these products have been made, reviewed, or approved by the U.S. Food and Drug Administration (“FDA”) or any other regulatory body. Nothing on the Site, in our marketing or advertising, on product labeling, or in communications with our team is a representation that these products are safe or appropriate for human use, and none of it should be construed as medical advice.

By purchasing or using any Spritz Biohack product, you represent, warrant, and agree that you:

  • are purchasing the product solely for lawful research, laboratory, or other non-consumptive purposes, and not for personal use, human consumption, or administration to any person or animal;
  • are at least 18 years of age and are legally permitted to purchase, possess, and use products labeled Research Use Only in your jurisdiction;
  • are solely responsible for determining the legality of purchasing, possessing, or using these products where you reside, and for using them in compliance with all applicable laws and safety practices appropriate to a research or laboratory setting; and
  • assume all risk associated with any use of the product, including any use inconsistent with this Section.

We disclaim any and all liability for injury, illness, or other harm resulting from consumption or human/animal use of these products, or from any use inconsistent with the Research-Use-Only purpose described in this Section.

5. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at support@spritzitup.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

6. Products, Pricing & Availability

We try to display accurate product descriptions, images, and pricing, but we do not warrant that this information iscomplete or error-free. We reserve the right to correct errors, update information, and cancel orders — includingafter an order confirmation has been sent — if a product or its price was listed incorrectly, or if the product isunavailable. Prices are subject to change without notice. All orders are subject to acceptance and product availability.

7. Subscriptions & Auto-Renewal

Some products are offered on a recurring subscription basis. By enrolling in a subscription, you authorize us and our payment processor to automatically charge your designated payment method on a recurring basis (for example, monthly) at the then-current subscription price, until you cancel.

  • You may cancel or modify your subscription at any time by emailing support@spritzitup.com, subject to any deadline described at checkout.
  • Cancellation requests must be received before your next scheduled billing date to avoid being charged for the upcoming cycle.
  • Introductory or “Founding Member” pricing is offered for a limited period as described at checkout, and may revert to standard pricing upon renewal or expiration of the promotional term.
  • We will provide advance notice of any material price increase to an active subscription, as required by applicable law.

8. Payment Terms

Payments are processed securely by our third-party payment processors. We do not store full payment card numbers. By providing payment information, you represent that you are authorized to use the payment method provided and authorize us to charge the applicable amount, including applicable taxes and shipping, to that payment method. We reserve the right to refuse or cancel any order we reasonably suspect involves fraud, unauthorized activity, or pricing error.

9. Shipping & Delivery

We currently ship only to addresses within the United States. Estimated delivery times are provided for convenience and are not guaranteed. Title and risk of loss for products pass to you upon delivery to the shipping carrier. We are not responsible for delays caused by carriers, weather, or other events outside our reasonable control.

10. Returns, Refunds & Cancellations

Our full return policy is available at https://spritzitup.com/return-policy/ https://spritzitup.com/privacy-policy/ and is incorporated into these Terms. In summary:

For health and safety reasons, opened or used products cannot be returned unless the item arrived damaged or defective.

  • Final sale items, promotional items marked final sale, and gift cards are not eligible for return.
  • Approved refunds are issued to your original payment method and may take 5–10 business days to appear, depending on your bank or card provider.
  • Original shipping charges are non-refundable unless the return is due to our error.

11. Marketing Communications; Email & SMS Consent

If you sign up for our newsletter, create an account, or opt in at checkout, you consent to receive marketing emails and/or SMS text messages from us about products, promotions, and updates. Message and data rates may apply to SMS messages. You may unsubscribe from marketing emails at any time using the link included in any email, and you may opt out of SMS messages at any time by replying “STOP” to any text. Opting out of marketing communications does not affect transactional messages related to your purchases, such as order confirmations and shipping updates.

12. Cookies, Pixels & Other Tracking Technologies — Your Consent

When you visit the Site, we and our service providers use cookies, pixels, tags, web beacons, software development kits (SDKs), and similar technologies (“Tracking Technologies”) to operate the Site, remember your preferences, analyze traffic and performance, and deliver and measure advertising — including advertising on third-party platforms.

These Tracking Technologies may include, among others:

  • Meta Pixel and Meta Conversions API — shares certain website and purchase-event data with Meta to measure and improve the performance of our advertising on Facebook and Instagram;
  • Google Analytics and Google Ads tags — help us understand Site usage and measure advertising performance;
  • TikTok Pixel — helps us measure and optimize advertising on TikTok;
  • Email and SMS engagement tracking (through our marketing platform) — tracks opens, clicks, and similar engagement to measure campaign performance.

Information collected through Tracking Technologies may include your IP address, device and browser information, approximate location (such as city or region derived from IP address), pages and products viewed, and purchase activity. This information may be linked to other information we hold about you, such as your email address (in hashed form, where required by the advertising platform), to build custom or lookalike audiences, retarget you with ads, and measure ad conversions.

By using the Site, you acknowledge and consent to the placement and use of cookies, pixels, and similar Tracking Technologies on your device as described in this Section and in our Privacy Policy, to the extent such consent is required under applicable law. Where required (for example, under certain state or international laws), we will present a cookie banner or similar mechanism allowing you to accept, reject, or manage non-essential cookies before they are set.

You have choices regarding Tracking Technologies:

  • Browser controls — most browsers let you block or delete cookies through their settings.
  • Platform ad controls — you can manage how Meta, Google, and TikTok use your information for advertising through each platform’s own ad-preference settings.
  • Global Privacy Control (GPC) — where recognized under applicable state law, we treat a GPC signal from your browser as a valid request to opt out of the “sale” or “sharing” of your personal information for cross-context behavioral advertising.
  • “Do Not Track” — our Site does not currently respond to browser “Do Not Track” signals other than as described above.

Disabling some Tracking Technologies may affect Site functionality or the relevance of ads you see, but will not prevent you from browsing the Site or purchasing products.

We do not sell your personal information for money. Depending on your state of residence, some of the advertising and analytics activity described above may be considered a “sale” or “sharing” of personal information under applicable law (for example, the California Consumer Privacy Act). See our Privacy Policy and Section 13 below for how to exercise your rights, including opting out of that sharing.

13. Your Privacy & State Law Rights

Our collection, use, and disclosure of personal information is described in detail in our Privacy Policy, which is incorporated into these Terms by reference. Depending on where you live — including California, Colorado, Connecticut, Utah, Virginia, and other states with comprehensive privacy laws — you may have the right to access, correct, delete, or obtain a copy of your personal information, and to opt out of targeted advertising or the sale/sharing of your personal information. To exercise these rights, contact us at support@spritzitup.com. We may need to verify your identity before responding.

14. User Content & Reviews

If you submit reviews, testimonials, photos, videos, comments, or other content to us — including through social media, influencer or ambassador programs, or user-generated content submissions (“User Content”) — you grant Spritz a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, and display that User Content in connection with marketing and promoting our products, in any media, without additional compensation, unless we have agreed otherwise with you in writing (for example, under a separate influencer agreement). You represent that you own or otherwise control all rights to the User Content you submit and that it does not violate any third party’s rights. We may remove or decline to post any User Content at our discretion.

15. Intellectual Property

The Site and its content — including text, graphics, logos, product names, images, and software — are owned by or licensed to Spritz and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written consent, except as necessary to use the Site for its intended purpose.

16. Prohibited Conduct

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site, other users’ accounts, or our systems; (c) interfere with or disrupt the Site’s functionality or security; (d) scrape, harvest, or collect data from the Site without our consent; (e) resell our products without our written authorization; (f) upload viruses or other malicious code; or (g) impersonate any person or entity.

17. Third-Party Links & Services

The Site may link to or integrate with third-party websites or services, such as payment processors and social media platforms, that we do not control. We are not responsible for the content, privacy practices, or terms of those third parties, and your use of them is at your own risk and subject to their own terms.

18. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PRODUCT WILL MEET YOUR EXPECTATIONS OR PRODUCE ANY PARTICULAR RESULT. SOME STATES DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SPRITZ AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE CLAIM. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

20. Indemnification

You agree to indemnify and hold harmless Spritz and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your misuse of our products, or your violation of any applicable law or third party’s rights.

21. Dispute Resolution; Arbitration; Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-laws principles, and by applicable U.S. federal law. Before filing any claim, you agree to contact us at support@spritzitup.com and attempt in good faith to resolve the dispute informally for at least 30 days. If we are unable to resolve a dispute informally, you and Spritz agree that any dispute arising out of or relating to these Terms or your use of the Site will be resolved by binding, individual arbitration under the Federal Arbitration Act, administered by [Insert Arbitration Provider, e.g., the American Arbitration Association] under its rules then in effect, rather than in court — except that either party may bring an individual claim in small claims court. YOU AND SPRITZ EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. You may opt out of this arbitration agreement by emailing support@spritzitup.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.

22. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and any other policies referenced here, constitute the entire agreement between you and Spritz regarding the Site. You may not assign these Terms without our prior written consent; we may assign these Terms at our discretion, including in connection with a merger, acquisition, or sale of assets.
